• The FreeKenya Movement has been active in Public Interest Litigation to ring fence constitutional provisions and ensure constitutionalism.
  In the following instances,FreeKenya Movement has moved to Court under public interest litigation to
• 1) Secure Political Rights for Independents Candidates and there by enable Kenyans to have variety of potential leaders to chose from
• 2) Ring Fence the Rights to Assemble, Demonstrate and Picket under Article 37 of the constitution.

• In March of 2023, Following requests from our supporters, especially after high rates of taxation becoming a thorn in the flesh for Kenyans following the passage of Finance Bill 2023. As such FreeKenya Movement moved to sought for collection of signatures to support our popular referendum initiative.
• Unfortunately, the OCS Central opposed our notification to the police citing security concerns. FreeKenya Movement moved to Court under urgency through Petition E122 of 2023 to ring fence Article 37 and seek guidance on the application of the operational law – The Public Order Act. Article 37 has been a huge bone of contention in as far as right of assembly have been in Kenya. This case brings to focus the question of rights to assemble. The case comes up for highlighting in open Court in September 23 2024.
