The illegal detention, enforced disappearance, and alleged torture of Bob Njagi and Nicholas Oyoo are not merely domestic incidents; they constitute grave breaches of multiple binding international and regional human rights instruments.
The Free Kenya Movement (FKM) is documenting every violation to build a legal case for justice and hold the perpetrators—and the state that sheltered them—fully accountable.
📜 Key International and Regional Violations
The actions of the Ugandan security operatives violated the fundamental rights of the Kenyan activists under the following crucial instruments:
- The African Charter on Human and Peoples’ Rights (ACHPR):
- Article 5 (Right to Dignity): This was fundamentally violated by the alleged torture and inhuman and degrading treatment during their 38-day detention.
- Article 6 (Right to Liberty and Security): The activists were detained without legal basis, charges, or recourse, constituting an arbitrary detention.
- The International Covenant on Civil and Political Rights (ICCPR):
- Article 9 (Liberty and Security of Person): Directly violated by their enforced disappearance and failure to be informed of the reasons for their arrest or to be brought promptly before a judge.
- The Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (CAT):
- As alleged torture victims, the activists’ rights were violated. This convention obligates state parties (like Uganda) to take effective legislative, administrative, judicial, or other measures to prevent acts of torture in any territory under its jurisdiction.
🇪🇦 The East African Community (EAC) Betrayal
Crucially, the incident undermined the principles of regional integration that Uganda is bound to uphold:
- The EAC Treaty (Articles 6 and 7): These articles emphasize good governance, democracy, the rule of law, social justice, and the promotion and protection of human rights as core operational principles of the Community. The abduction and detention are a stark betrayal of these shared values.
- Protocol on the Establishment of the EAC Common Market (Free Movement of Persons): The activists were engaging in legitimate cross-border civic work. Their seizure undermines the very spirit of the Common Market, which is meant to facilitate movement without fear of arbitrary state action.
The FKM will leverage these documented breaches to seek justice and protective orders from regional and international bodies, ensuring that the perpetrators of this state-sponsored terror cannot act with impunity again.
